Gay Marriage Law Causes Prisoner Dilemma

ST. PAUL, Minn. (AP) – Three same-sex couples in state custody as sex offenders are seeking marriage licenses under Minnesota’s gay marriage law.

Minnesota Public Radio News reports Monday that the new law is causing thorny questions for state officials who supervise incarcerated people. While no same-sex couples in the state’s prison system have sought to marry so far, the request from a handful in the Minnesota Sex Offender Program has not produced a clear answer.

People in that program served prison sentences but remain in custody by judicial order. Two men housed in the Moose Lake facility contacted their county recorder for a license, but the state Department of Human Services denied their transportation request to apply in person, as required.

The department is reviewing its transportation policy in light of the law.
