MINNEAPOLIS (WCCO) — There will be no felony charges filed against the driver of the car that plunged into a retention pond in St. Louis Park last fall, killing two young children, according to the Hennepin County Attorney’s Office.
The driver, Marion Noel Guerrido, was traveling with five children in the car at around 7 a.m. on Nov. 21, 2014. While on the ramp from Minnesota 7 to Minnesota 100, her car went out of control, she over-corrected and the car ended up in the retention pond.
Guerrido tried to rescue the children, but it took emergency responders to pull them out. Two children, 7-year-old Alarious Guerrido and 5-year-old Zenavia Rennie, died as a result.
County attorney Mike Freeman says the investigation revealed that Guerrido was not speeding, did not have drugs or alcohol in her system and wasn’t on her phone. It seems she just over-corrected and spun out.
“This is a horrible, horrible tragedy and there is nothing the criminal justice system can or should do about it,” Freeman said.
St. Louis Park spokeswoman Jamie Zwilling says there is a possibility of pursuing charges at the city level, which means misdemeanors or below. They will make a determination possibly by the end of the week.
