Wis. Appeals Court Rejects Appeal In 2001 Killing

MADISON, Wis. (AP) — A Wisconsin appeals court has rejected an appeal of a Minnesota man who was convicted of first-degree intentional homicide in the 2001 killing of a man left for dead along a western Wisconsin logging road.

The 3rd District Court of Appeals ruled Tuesday that Jeffrey Burr, of Welch, Minn., was not entitled to a new trial based on newly discovered evidence because it is not reasonable that a new trial would produce a different result.

The court says the evidence constitutes double hearsay and would not be admissible at a new trial.

Burr was 15 at the time of the killing of Ronald Ross, of Oakdale, Minn.

Burr, who is now 27, was sentenced to life in prison with no eligibility for parole for 60 years.
