MINNEAPOLIS (WCCO) – Authorities said Monday a Stearns County deputy won’t face charges after shooting and injuring a murder suspect back last October.

Officials with the Stearns County Attorney’s Office said they decided not to file charges against Chad Meemken, finding that his use of deadly force against Marcus Michael Barshaw on Oct. 21, 2012, was justified.

Police were called to the 300 block of Broadway Street in Rockville to investigate the shooting death of Jeffrey Jerome Schutz. Police say Barshaw shot Schutz, 30, dead in front of two or three other people around 4 a.m. that day inside a Rockville apartment. Police say Barshaw was an acquaintance of the people in the home.

Barshaw, the primary suspect in the case, had fled the scene by the time authorities arrived. Several hours later, authorities located Barshaw in a nearby apartment building. They confronted him, and Barshaw started to point a gun at Meemken, who shot and injured Barshaw.

Barshaw was indicted for first-degree murder and Schutz’s murder and is currently in the Stearns County Jail awaiting trial.
